The Failure of the 28-Article Peace Initiative for Ukraine: Why Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency sparked by the introduction of a new comprehensive peace framework for resolving the conflict appeared – temporarily – to have been defused. A American diplomat spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, Moscow made its response: a renewed assault of rocket attacks on Kyiv.

The Pattern of Negotiation and Warfare

The sequence of contrasting events captured the grim essence of the current period. By day, negotiation efforts are fought: positive announcements are released from multiple capitals. Significant resources is devoted on containing specific proposals. By night, Russian leadership brutally reminds the world that, for them, conflict continues to be the primary tool for achieving "resolution".

Nocturnal Warfare

As the offensive progressed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was revealed. Ukraine is capable of detecting missile launches from Russian territory, a capacity afforded by current data. From observation points, military aircraft that had been dispatched to engage hostile cruise missiles streaked across the sky – modern combat jets supplied to Ukraine by Western partners.

Soon thereafter, Kyiv's air-defence systems activated: multiple launches targeted at a hostile projectile. This was a advanced protection mechanism at work, most likely provided by partner states. Every deployment creates sudden vibrations, shaking the windows. The instant of fear quickly gives way to resigned acknowledgment: maybe the incoming missile won't strike its target this time, protecting urban areas from catastrophe and further power outages.

Continuous Dangers

Not long after, a heavy machine gun opened up on a unmanned aircraft in the vicinity, part of a rapid response unit – most likely imported technology. Sadly, the projectiles didn't strike the opposing UAV – it maintained course toward its objective.

Intermittently, this continued until dawn. Kyiv faced the morning news: multiple fatalities, destruction and infrastructure problems in many homes as a result of the evening attack. As customarily, everyone still continued their routines – living the war. But those full day encapsulated Ukraine's essential dependence on international aid – a dependence that neighboring countries are clearly incapable to fill in the immediate future.

Failed Diplomacy

The detailed framework from Washington provoked deep reactions, debate and serious worry – and momentarily shifted focus from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after earlier high-level meetings and international summits.

Every new initiative from Washington unfolds according to the same pattern: a negotiation push against Ukraine, which Kyiv, with allied governments, effectively counters. They manage the tension but never actually secure success. This cycle will, no doubt, continue.

Tactical Assessments

It is easy to blame certain parties of persistently promoting Kremlin's demands. But that does not seem to be the complete picture. US administration functions according to a assumption understood by experienced diplomats: you cannot win at the negotiating table what you have been unable to protect through force. The White House believes that it is unfeasible to compel Moscow to abandon the territory that it presently holds in Ukraine's occupied territories.

The issue is that while acknowledging this situation, US leadership does little to discourage Russia, through statements or actions, from assuming that the situation will not change more in its advantage in the months ahead.

Divergent Views

Therefore, Russian leadership is certain that the clock favors them – that Ukraine and its allies are approaching exhaustion. Their motivation to agree to terms that does not give them the maximum possible gain is virtually nonexistent. There may be many attempts to stop fighting, but they will carry on as long as Russia's government remains completely certain in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, gradually sacrificing people and territory but avoiding a total frontline collapse until situations evolve in its favour.

Existing Situation

Realistically, there are no actual prerequisites for a armistice. Now, personal considerations are entering the equation: personal goals to mediate resolution and achieve global acclaim, and Ukrainian leadership's dual difficulties – on one hand, not to alienate a key ally, and on the other, to mobilize citizens around the national cause against any initiative Kyiv finds unworkable, so that their attention does not move to domestic problems. And although their task will now be significantly challenging after latest incidents, it remains highly unlikely that this will alter their fundamental strategy.

These two forces are guiding negotiations.

Assessment and Future

It took a only one week to eliminate the proposed articles of the latest plan. Aggressive and erratic handling of the matter by American leadership, pushback by Ukraine and the remaining European nations, along with soothing efforts of diplomats, and finally, latest revelations, all served their function.

While new plans based on old ideas are imminent, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are rooted in Kremlin requirements and reflect certain reluctance to alter the situation, if they stand together and improve their protective measures at a much faster pace. If they do, neither external pressure nor military threats will be able to break them. In the meantime, Ukraine's capability to defend against evening bombardments will, for the foreseeable future, mainly require sustained allied backing.
